These Repair Terms of Service (the “Agreement”) apply to all repair services (the “Services”) provided by **Phone Urgent Care**, available exclusively for customers within select areas of **Nassau County, New York**. By utilizing our Services, You (the “Customer”) agree to the terms outlined herein. **1. Definitions**
In this Agreement:

**3. Authorizations**

**4. Service Availability**
Our Services are only available to residents within select areas of **Nassau County**, and include **pick-up and drop-off** of devices for repair. We reserve the right to refuse services for areas not covered by our Service Area or where repairs would be deemed impractical.
**5. Device Back-Up Responsibility**
You are solely responsible for backing up data from your Device before submitting it for repair. **Phone Urgent Care** is not liable for any data loss that may occur during or after the repair process.
**6. Parts and Warranty**
We may use new, refurbished, or non-OEM parts to repair Your Device. You acknowledge that:
- Non-OEM or refurbished parts may be used, and they may differ from the original manufacturer’s parts.
- Services performed may void the manufacturer’s warranty.
- We provide a **30-day warranty** on parts and repairs, excluding any damage caused by misuse or liquid exposure post-repair.
**7. Payment Terms**
You agree to pay for all Services as outlined in the Service Authorization provided before the repair. Any changes to the service cost will be communicated prior to proceeding with repairs.
**8. Limitation of Liability**
We are not responsible for any incidental or consequential damages arising from the use of our Services. Liability for any claim related to repair services will not exceed the total repair cost.
**9. Dispute Resolution & Arbitration**
In the event of a dispute, both parties agree to resolve the matter through binding arbitration rather than litigation. Claims must be submitted within **30 Days** of the event giving rise to the dispute.
